The woman who accused Jay-Z and Diddy of raping her when she was 13-years-old has submitted a motion to dismiss a lawsuit filed against her by Hov, TMZ reports.
On Tuesday, the woman submitted new legal documents to have the defamation lawsuit Jay filed against her and her lawyer Tony Buzbee, dismissed. According to the filing, Jay can’t sue her because the claims she made were listed in court documents, and she used an interview she did with NBC to ensure the “fair report privilege,” a legal doctrine that shields people from defamation cases as long as the allegations were accurately reported.
“The average person watching the report, and indeed anyone watching the report, would certainly understand that the statements refer to allegations in the lawsuit,” the woman’s legal team said in the filing.
Buzbee also filed a motion to dismiss Jay’s lawsuit against him, stating they came to an agreement, but the rapper then pulled out of the deal. Jay and his legal team have since denied that he and Buzbee struck a deal.
Jay sued the woman or defamation, malicious prosecution and other wrongdoing back in March after she dropped her initial lawsuit filed in December accusing him and Diddy of raping her when she was just 13. In his lawsuit, Jay claimed the woman and Buzbee were carrying out an “evil conspiracy” to extort him.
“Mr. Carter does not commence this action lightly,” wrote Jay’s lawyers at the time. “But the extortion and abuse of Mr. Carter by Doe and her lawyers must stop.”
Jay-Z has said that the dismissed case resulted in a $20 million loss in income.
